This position is governed by state and federal laws and agency/institution policy.FunctionsPresides over public and non-public hearings by hearing testimony of witnessed, questioning witnesses, hearing argument of attorneys and witnesses, resolving procedural questions, reading legal and administrative documents, and ruling on post-hearing motions. Reviews claim cases by reading files and legal briefs, conducting legal research, and conducting pre-hearing conferences with legal representatives of both parties, if necessary, to further define issues. Provides legal representation for the PSC in complex utility cases before federal agencies and courts. Researches, analyzes, and evaluates policies and legal precedents for developing reports, legal pleadings, motions, responses, briefs, and agreements. Attends legal seminars and conferences and reads legal, technical, and professional publications to continue legal education as required by law. Grants or denies postponements and continuances based on facts presented and need for additional information. Develops major plans, goals, and objectives for programs, forecasts service needs, and monitors and evaluates program effectiveness. Maintains appropriate contact with federal, state, and local officials and other members of the community. Interprets goals, policies, and programs to communicate the agency mission. Represents the agency in meetings, committees, conferences, and workgroups. Performs other duties as assigned.DimensionsNoneKnowledge, Skills and AbilitiesKnowledge of state and federal utility and regulatory law, regulations, and precedents. Knowledge of the theory and basis for regulation and ratemaking. Knowledge of emerging economic, technological, legislative, judicial, and regulatory issues and trends affecting the utility industries. Knowledge of legal research techniques including use of Westlaw and other internet research tools. Ability to preside over hearings. Ability to prepare oral and written information and reports. Ability to communicate to a diverse group of people. Ability to analyze data and prepare reports.Minimum QualificationsLicensed to practice law and admitted to the Arkansas State Bar in accordance with ACA 16-22-201. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management. Demonstrated sound understanding of all aspects of public utility regulatory law.
