Job Description

This role works with the Compliance and Legal teams to ensure that PharmaCann, Inc. and its subsidiaries (collectively, “PharmaCann” or the “Company”) are compliant with all cannabis marketing and advertising rules and regulations in the jurisdictions in which the Company operates. This position will report to the Vice President of Global Compliance and will work closely with the Company’s Marketing department. The Marketing and Advertising Regulatory Compliance Associate will review all marketing and advertising materials to ensure that the materials adhere to legislative and regulatory requirements. This role is based out of PharmaCann’s headquarters located in Chicago, IL.

Essential Functions/ Responsibilities

· Collaborate with the Marketing team to develop and maintain marketing and advertising best practices, policies and programs to ensure that marketing campaigns and corresponding materials are in compliance with cannabis regulations.

· Assist with the development of an efficient marketing review process and provide constructive recommendations for improvement.

· Review and manage marketing and advertising compliance requests in a timely manner.

· Interpret and apply state specific cannabis regulations and federal regulations (HIPAA, FDA, IP, Truth in Advertising, etc.) as they apply to marketing and advertising.

· Use independent judgment and knowledge of applicable state and federal regulations to provide compliance feedback, guidance and recommendations to the Marketing team.

· Submit and manage marketing and advertising materials to state regulators for pre-approval.

· Review and disseminate advertising and marketing guidance, bulletins and updates provided by regulators and communicate changes to the Marketing team.

· Provide educational training to our new markets and new members of Marketing.

· Keep abreast of the rules, regulations, and statutes relating to marketing and advertising requirements and restrictions.

· Develop and apply standards for web-based and social media related marketing activities in partnership with the Legal team.

· Maintain compliance component of the marketing review tracking tool.

· Execute marketing and advertising initiatives in a timely manner through effective interaction and communication with individuals, both internally and externally (when applicable).

· Identify areas of concern or high risk for escalation to the VP of Global Compliance and VP of Legal and propose potential solutions.

· Keep the Compliance and Legal teams informed of marketing projects and initiatives.

· Communicate with state regulators and inspectors as needed.

· Assist with implementing PharmaCann’s policies, procedures, and best practices to promote compliance.

Qualifications

Competencies

· Understanding of the regulatory environment and rules and regulations applicable to the cannabis industry or other applicable regulated industries such as pharmaceutical, healthcare, alcohol, or hemp producers.

· Strong analytical skills, including demonstrated experience identifying and quantifying complex problems and providing effective resolutions.

· Detail oriented, excellent judgment and time management with ability to manage multiple projects and set priorities.

· Able to communicate in a professional manner both internally and with regulators.

· Ability to work autonomously as well as within a team environment.

· Performs well under pressure on multiple tasks concurrently and meets deadlines in a fast-paced work environment.

· Ability to adapt quickly to changing priorities and willingness to handle a variety of tasks across a broad range of substantive areas and to learn new areas quickly.

· Excellent verbal and written communication skills.

· Strong research and organizational skills.

Qualifications

· Juris Doctorate Degree from an ABA accredited school preferred.

· Minimum of 3-5 years of compliance experience, ideally in the regulated cannabis industry or another regulated industry, such as pharmaceutical, alcohol, gaming, tobacco.

· Law firm and/or regulatory experience is preferred.

· Strong working knowledge of the cannabis industry is preferred.
