At this time, agencies may recruit and hire employees by making permanent non-competitive appointments and the official probationary period will begin.At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Duties Description Incumbent will be assigned a variety of legal tasks in the Office of General – Legal Affairs Division. TheSenior Attorney will be required to have strong research and writing skills, and a demonstrated interest in government and administrative law. The Senior Attorney will be responsible for reviewing Full Board Review applications and preparing memoranda with recommendations regarding whether the Board Panel decision under review is supported by substantial evidence. Incumbent will be required to review the Full Board Review application and the evidence in the record, articulate the issue(s) raised, ascertain, and summarize the relevant facts, perform legal research, apply the law to the facts, and draft a recommendation following a standardized format within the parameters of the Workers’ Compensation Law. Incumbent will also be assigned to respond to legal questions from stakeholders, other departments within the Board, other agencies, and the public. Other duties may include drafting policy statements, rules, and regulations; addressing Freedom of Information Law (FOIL) requests; reviewing case law and Board precedent to draft standardized legal text for use in Board decisions; and providing legal memoranda on a variety of issues.
